Reply LS on external data channel content access requirements
This is a Reply Liaison Statement (LS) from SA1 to SA, responding to GSMA NG UPG's inquiry regarding external data channel content access requirements. The document addresses regulatory considerations for IMS Data Channel applications, particularly concerning HTML and JavaScript content.
SA1 provides a response to Question 6 from NG UPG, which concerns the regulatory treatment of IMS Data Channel applications defined in 3GPP TS 26.114, specifically addressing the regulatory distinction between:
- IMS telephony services (subject to telecom regulation)
- HTML and JavaScript content (typically not subject to telecom regulation)
SA1 clarifies the regulatory framework as follows:
When IMS Data Channel is part of IMS telephony services:
- IMS Data Channel applications, including their HTML and JavaScript content, are expected to be subject to local telecom regulation
When used for other services (e.g., standalone Data Channel):
- Subject to applicable regulations, which could also include local telecom regulations
Regarding regulatory exceptions:
- The existence of any exceptions is contingent upon the applicable regulations
- SA1 explicitly states it is not within their scope to determine which specific regulation(s) HTML and JavaScript content would be subject to
SA1 requests SA to:
- Consolidate SA1's reply with responses from other working groups
- Provide a consolidated response to GSMA NG UPG
